Texas Home Inspection Marketplace Terms of Service

HONEST HOME INSPECT

(A DBA of OBZA LLC)

These Terms of Service (“Agreement”) govern your access to and use of the Honest Home Inspect website, booking tools, and related services (collectively, the “Platform”).

By accessing the Platform, scheduling an inspection, submitting payment, or receiving inspection-related services, you (“Client”) acknowledge that you have read, understand, and agree to be bound by this Agreement.

1. Marketplace Disclosure (Important)

Honest Home Inspect operates solely as an online marketplace that connects clients with independent, Texas-licensed home inspectors.

Honest Home Inspect does not perform home inspections. All inspection services are performed exclusively by independent inspectors who are not employees, agents, or representatives of Honest Home Inspect or OBZA LLC.

Honest Home Inspect facilitates scheduling, communication, and payment through the Platform but is not a party to the inspection services provided by the independent inspector.

2. Role of the Independent Inspector

Each inspection is performed by an independent home inspector who:

  • Is licensed by the Texas Real Estate Commission (TREC)
  • Operates as an independent contractor
  • Is solely responsible for inspection methods, findings, conclusions, reports, and conduct

Honest Home Inspect does not supervise, direct, control, or influence how inspections are performed.

3. Scope of Inspection

All inspection services described in this Agreement are performed exclusively by the independent inspector, not by Honest Home Inspect or OBZA LLC.

The inspection is a visual, non-invasive assessment of readily accessible components of the property at the time of inspection, conducted in accordance with the TREC Standards of Practice, unless otherwise agreed in writing between the Client and the inspector.

Inspections may include, but are not limited to:

Structural Components

Foundation, grading and drainage, roof structures, interior and exterior walls, ceilings, and floors.

Roofing

Covering materials, flashings, penetrations.

Electrical Systems

Branch circuits, connected devices, fixtures, smoke and carbon monoxide detectors.

Plumbing Systems

Supply lines, drain lines, fixtures, water heating equipment.

HVAC Systems

Heating and cooling equipment, heat pumps, duct systems.

Interior / Exterior Components

Walls, ceilings, floors, windows, doors, permanently installed appliances, wall cladding, trim, attached garages and carports.

Each inspection is unique. Certain systems or components may be limited or excluded due to accessibility, weather conditions, or property characteristics present at the time of inspection.

4. Inspection Limitations

Visible and Accessible Areas Only

Inspectors do not move furniture, stored items, appliances, vehicles, insulation, or personal belongings. Concealed or inaccessible areas are excluded.

Not a Code, Engineering, or Warranty Inspection

The inspection is not a code compliance inspection, engineering analysis, appraisal, or warranty. It does not evaluate future performance, life expectancy, or insurability.

Excluded Systems and Conditions

Unless separately agreed in writing, inspections exclude pools and spas, septic systems and wells, detached structures and outbuildings, and environmental hazards (mold, asbestos, radon, lead).

Weather Limitations

Adverse weather may restrict inspection of roofing, drainage, or exterior systems. Any limitations will be noted in the report. Reinspections for weather-related omissions may be available for a non-negotiable fee of up to $250, payable to the independent inspector.

5. Client Responsibilities

  • Access: The Client must ensure safe and complete access to the property at the scheduled inspection time.
  • Utilities: Electricity, water, and gas must be active and functional. If utilities are off or systems inaccessible, a reinspection fee may apply.
  • Pets: All pets must be secured to ensure safety.
  • Occupant Interference: If an inspection cannot be completed due to occupant interference, hostility, or refusal of access, no refund will be issued. A reinspection fee may apply.

6. Use of Inspection Materials

The Client agrees that Honest Home Inspect, OBZA LLC, and affiliated platforms may store and use inspection reports, photographs, 3D scans, and related materials for:

  • Platform operations
  • Quality improvement
  • Training
  • Service enhancement

Personally identifiable Client information will not be publicly disclosed except as required by law or as described in the Privacy Policy.

7. Data Use, Referrals & Communications

Client information is collected, used, and shared in accordance with the Privacy Policy and Cookie Policy, which are incorporated into this Agreement by reference.

Following an inspection, Honest Home Inspect may share customer information with third-party home service providers, in exchange for compensation, as part of service recommendations or referrals. Clients may opt out of such sharing at any time as described in the Privacy Policy or by contacting [email protected].

8. Payments, Cancellations & Fees

Honest Home Inspect facilitates payment processing on behalf of independent inspectors.

Cancellation & Rescheduling

Cancellations or rescheduling requests must be made at least 24 hours prior to the scheduled inspection time.

If a cancellation or rescheduling request is made with less than 24 hours’ notice, or if the inspection cannot be completed due to lack of access, utilities being off, occupant interference, or other client-controlled conditions, the Client may be charged a non-refundable cancellation or reinspection fee of up to $250.

Such fees are set and charged by the independent inspector, not by Honest Home Inspect.

No-Show Policy

Failure to appear at the scheduled inspection time, refusal of access, or conditions that prevent the inspection from being performed may be treated as a cancellation without notice and may result in a non-refundable fee of up to $250.

Platform Fees

Honest Home Inspect does not control inspection pricing, cancellation fees, or reinspection fees. Any marketplace or platform service fees charged by Honest Home Inspect are separate from inspection fees and may be non-refundable where permitted by law.

9. Limitation of Liability

Platform Services

To the maximum extent permitted by Texas law, Honest Home Inspect’s liability, if any, arising solely from marketplace or platform-related services is limited to the marketplace fees paid to Honest Home Inspect by the Client.

Inspection Services

All liability arising from inspection services, inspection reports, findings, conclusions, or property damage rests solely with the independent inspector who performed the inspection.

No Warranty

Neither Honest Home Inspect nor OBZA LLC provides any warranty, guarantee, or insurance regarding the condition, performance, or future suitability of any property.

10. Dispute Resolution (Important Distinction)

Inspection-Related Disputes

Any dispute, claim, or controversy arising from or related to inspection services, inspection findings, inspection reports, or the conduct of the independent inspector must be resolved solely between the Client and the independent inspector.

Honest Home Inspect and OBZA LLC are not parties to inspection-related disputes and have no obligation to mediate or arbitrate such claims.

Platform-Related Disputes

Disputes arising solely from use of the Platform shall first be submitted to mediation and, if unresolved, resolved by binding arbitration in the State of Texas.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.

12. Acceptance & Electronic Consent

By accessing the Platform, scheduling an inspection, or submitting payment, the Client acknowledges and agrees to this Agreement. Electronic acceptance and online booking constitute valid and binding acceptance.
